
An unauthorised occupier of a Council property is someone left living in a council home without succession rights, after the tenant dies or moves out of the property. Bolton at Home must decide whether they can remain at the property.
If we receive information about, or suspect that a tenant has moved away or died and left someone in occupation, we will visit them to investigate, establish the facts, and decide if the person left there can stay.
If there is a right to succession, we allow that person to succeed to the tenancy; we do not grant a new tenancy because it already exists and continues.
If there is no right to succession, the person has no right to stay in the property; a notice to quit must be served to terminate the deceased person’s tenancy. If a person continues to remain at the property, we would seek to obtain a Court Order for possession and evict that person under the squatters procedure. The Council may seek to recover its legal costs from the unauthorised occupant.
If someone remains in the property after the tenant has moved out, or moves into the property without our permission, we must ask them to leave and if they do not do so, we may seek a Court Order for Possession. The Council may seek to recover its legal costs from the unauthorised occupant.
